Terms of Use — absOrbs

v1.0 — pending legal review. This is the working draft for absOrbs. Treat the language as authoritative for what the app actually does; the legal phrasing is being refined.

1. Acceptance

By installing or using absOrbs, you agree to these Terms of Use. If you don’t agree, don’t install or continue using the app.

absOrbs is published by CaliKo LLC (“we”, “us”, “our”). These Terms form a binding agreement between you and CaliKo LLC.


2. License

We grant you a personal, non-exclusive, non-transferable, non-sublicensable, revocable license to install and use absOrbs on devices you own or control, for personal, non-commercial purposes.

You don’t acquire any ownership rights in absOrbs. The app, its code, art, audio, and design are protected by copyright and other intellectual-property laws.

4. In-app purchases

absOrbs offers one optional in-app purchase: Remove Ads. All purchases are processed by Apple App Store (on iOS) or Google Play Store (on Android). The respective platform’s terms govern the transaction, including refunds.


5. Advertising

absOrbs is free, supported by interstitial ads served by Google AdMob. We use the AdMob SDK and Google’s User Messaging Platform to gather consent where required by law (GDPR, CCPA, state-privacy laws). Personalized vs. non-personalized ad behavior depends on your consent decisions. See our Privacy Policy for the full disclosure.

Purchasing the Remove Ads in-app product removes interstitial ads.


6. Updates

We may release updates to absOrbs from time to time, including bug fixes, balance changes, feature additions, and changes to in-app purchases or advertising behavior. Updates are delivered via the App Store or Google Play.

We may also modify, suspend, or discontinue absOrbs (in whole or in part) at any time, with or without notice. We’re not liable for any losses or inconvenience caused by such changes — within applicable law.


7. Disclaimers

absOrbs is provided “as is” and “as available.” To the maximum extent permitted by law, CaliKo LLC disclaims all warranties, express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, non-infringement, and accuracy.

We don’t warrant that absOrbs will be uninterrupted, error-free, or free of harmful components. We don’t warrant that the in-app-purchase mechanism, the advertising system, or any third-party service used by absOrbs will operate continuously.


8. Limitation of liability

To the maximum extent permitted by applicable law, CaliKo LLC, its officers, members, employees, agents, suppliers, and licensors will not be liable for any indirect, incidental, special, consequential, or punitive damages — including loss of profits, loss of data, loss of goodwill, or other intangible losses — arising out of or in connection with your use of (or inability to use) absOrbs.

Our aggregate liability to you for any direct damages, regardless of form of action, will not exceed the greater of (a) the amount you’ve paid to CaliKo for absOrbs in the 12 months preceding the claim, or (b) ten US dollars ($10). Some jurisdictions don’t allow this limitation; in those jurisdictions, our liability is limited to the maximum extent permitted by law.

If any third-party provider’s terms conflict with these Terms, those provider’s terms govern that provider’s services. Our license from each provider doesn’t modify your direct license from them.


10. Attribution

absOrbs uses the following third-party assets under their respective licenses:

11. Governing law and venue

These Terms are governed by the laws of the State of California, USA, without regard to its conflict-of-law principles. Any dispute arising out of these Terms or your use of absOrbs will be resolved in the state or federal courts located in San Francisco County, California, and you consent to personal jurisdiction there.

If you’re consuming absOrbs from outside the United States, you’re responsible for compliance with your local laws.


12. Changes to these Terms

We may update these Terms from time to time. The “Last updated” date at the top of the page will change when we do. Material changes will also be flagged in the absOrbs release notes on the App Store and Google Play.

Continued use of absOrbs after a change constitutes acceptance of the revised Terms. If you don’t agree to a revision, please stop using absOrbs and uninstall.
